5. Deposits & Pre-Orders

Where a product is sold as a pre-order or requires a deposit, the deposit is non-refundable unless otherwise required by Australian Consumer Law.

6. Vehicle Use & Compliance

All ExoticKart vehicles are intended for use on private property, closed courses, or approved recreational facilities only.

ExoticKart vehicles are not road-legal and must not be operated on public roads, streets, footpaths, or any area requiring registration.

The purchaser is responsible for complying with all local laws, regulations, and safety requirements relating to the ownership and operation of the vehicle.

7. Risk & Responsibility

The operation of any motorised vehicle carries inherent risks.

By purchasing and operating an ExoticKart vehicle, the customer accepts responsibility for its safe use, maintenance, storage, and operation.

ExoticKart is not responsible for injuries, losses, damages, fines, penalties, or claims arising from misuse, negligence, unauthorised modifications, or operation contrary to applicable laws.

8. Warranty

Products supplied by ExoticKart may include a manufacturer’s warranty or a warranty provided by ExoticKart.

Warranty coverage does not apply to:

• Normal wear and tear
• Cosmetic damage after delivery
• Misuse or abuse
• Accidents or collisions
• Improper maintenance
• Unauthorised modifications or repairs

Warranty claims must be submitted with supporting photographs and proof of purchase.

9. Limitation of Liability

To the maximum extent permitted by law, ExoticKart shall not be liable for any indirect, incidental, special, or consequential loss, including loss of income, profits, business opportunities, or enjoyment arising from the purchase or use of our products.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

10. Shipping & Delivery

Delivery timeframes are estimates only.

ExoticKart is not responsible for delays caused by shipping carriers, customs processes, weather events, or circumstances beyond our reasonable control.

Risk in the product passes to the customer upon delivery.

11. Intellectual Property

All content on this website, including images, logos, graphics, text, videos, and branding, remains the property of ExoticKart and may not be copied, reproduced, or used without written permission.
